1. Acceptance
This website is operated by ECAM Trade LLC (“ECAM Trade”). By accessing it you agree to these terms. If you do not agree, please do not use the site. If you are using it on behalf of a company, you confirm you are authorised to accept these terms for that company.
2. What this site is for
This site describes ECAM Trade's sourcing, private label manufacturing, distribution and logistics services to prospective and existing business clients. It is intended for business use. It is not a consumer storefront, nothing can be purchased through it, and no payment is ever collected here.
3. Quotes, pricing and lead times are indicative
This is the section that matters most. Product descriptions, capabilities, specifications, minimum order quantities, indicative pricing, landed-cost assumptions, capacity figures and lead times published on this site or supplied in response to an inquiry are estimates for discussion, not binding offers.
Nothing on this site constitutes an offer capable of acceptance. In particular:
- Indicative pricing depends on specification, volume, raw material cost, factory loading, freight rates and duty treatment at the time of order — all of which move.
- Lead times are estimates based on normal conditions and are subject to factory scheduling, inspection outcomes, vessel availability and customs clearance.
- A binding commitment arises only from a written agreement, purchase order or proforma invoice signed or countersigned by ECAM Trade, which will set out the governing commercial terms including Incoterms, payment terms, quality specification and tolerances.
Where those signed documents and this website conflict, the signed documents prevail.
4. Submitting an inquiry
When you send an inquiry through this site you agree to provide accurate information and to use the forms only for genuine business inquiries. We handle what you send in accordance with our Privacy Policy.
Sending an inquiry creates no obligation on either side. We may decline any inquiry, including where a request falls outside our capabilities or would not satisfy the screening described in our Trade Compliance page.
Please do not send confidential technical information, formulations or designs before we have a mutual non-disclosure agreement in place. We are happy to put one in place — just ask.
5. Acceptable use
You agree not to:
- Use the site for any unlawful purpose, or in breach of any applicable export control or sanctions law
- Submit automated, bulk, fraudulent or deliberately misleading form submissions
- Attempt to gain unauthorised access to the site, its hosting or any connected system
- Scrape, republish or systematically extract site content for a commercial purpose
- Interfere with the site's operation or availability for others
6. Intellectual property
The content, layout, design, graphics and text of this site are owned by ECAM Trade or licensed to it, and are protected by copyright and trade mark law. You may view, download and print pages for the internal purpose of evaluating our services. Any other reproduction, redistribution or commercial use requires our prior written permission.
Third-party brand names or benchmark products referenced on this site are the property of their respective owners. Any such reference describes a comparable technical benchmark or a category we manufacture for, and does not imply endorsement by, affiliation with, or a licence from that owner.
7. Third-party links
This site may link to third-party services we do not control. We are not responsible for their content, availability or privacy practices. Following an external link is at your own discretion.
8. Availability
We aim to keep this site available and accurate, but we provide it “as is” and give no warranty that it will be uninterrupted, error-free, or that the information on it is complete or current. We may change, suspend or withdraw any part of it without notice.
9. Limitation of liability
To the fullest extent permitted by law, ECAM Trade is not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, business, contracts or anticipated savings, arising from your use of — or inability to use — this website, or from reliance on indicative information published on it.
Nothing in these terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited. Liability arising under a signed sourcing agreement is governed by that agreement, not by this section.
10. Indemnity
You agree to indemnify ECAM Trade against claims, losses and reasonable costs arising from your breach of these terms or your misuse of this site.
11. Governing law
These terms and any dispute arising from them are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules. The state and federal courts located in New Jersey have exclusive jurisdiction, and both parties submit to that jurisdiction.
12. Changes
We may update these terms from time to time. The version in force is the one published here, dated at the top of this page. Continuing to use the site after a change means you accept the revised terms.
